Therafic Terms & Conditions

These Terms & Conditions (“Terms”) govern access to and use of Therafic services.
By accessing or using Therafic services, users agree to these Terms.
1. ACCEPTANCE OF TERMS
By using Therafic services, users confirm that they:
– Are legally capable of entering agreements
– Agree to comply with applicable laws
– Accept these Terms in full
2. SERVICES
Therafic provides:
– SaaS software
– White-labeled CRM systems
– Automation tools
– AI tools
– Marketing services
– Communication systems
– Funnel and website tools
– SMS and email systems
– Related business services
Services may change at any time without notice.
3. ACCOUNT RESPONSIBILITIES
Users are responsible for:
– Maintaining account confidentiality
– Protecting login credentials
– Ensuring lawful use of the platform
– Managing authorized users
– Reviewing automated and AI-generated outputs
4. SUBSCRIPTION BILLING
Users authorize recurring billing for subscription services.
Users agree that:
– Fees are billed in advance
– Subscription charges may renew automatically
– Failure to pay may result in suspension
– Pricing may change with notice
5. CANCELLATION & REFUNDS
– Minimum commitment period is one (1) month
– Users may cancel future renewals at any time
– Active billing cycles remain payable in full
– Missed onboarding sessions may be rescheduled
– Refunds are granted solely at Therafic’s discretion unless otherwise agreed in writing
Third-party fees, ad spend, setup fees, and completed services are generally non-refundable.
6. ACCEPTABLE USE
Users may not:
– Send spam
– Violate TCPA, CAN-SPAM, HIPAA, GDPR, or privacy laws
– Engage in deceptive marketing
– Upload malicious code
– Use unauthorized contact lists
– Harass or abuse others
– Infringe intellectual property rights
– Use the platform unlawfully
7. SMS MESSAGING TERMS
Users utilizing SMS functionality agree:
– To obtain express consent before messaging contacts
– To honor opt-out requests
– To comply with carrier rules and laws
– Not to send prohibited content
Users remain solely responsible for message content, consent collection, and legal compliance.
8. HIPAA RESPONSIBILITIES
Users acknowledge:
– Therafic is not a healthcare provider
– Users remain responsible for HIPAA compliance
– Users must avoid storing unnecessary PHI
– Users are responsible for obtaining patient consent
– Users must ensure lawful workflows
9. AI DISCLAIMER
Therafic AI tools may produce inaccurate, incomplete, or misleading outputs.
Users agree to independently review all outputs before relying upon them.
Therafic makes no guarantees regarding:
– Accuracy
– Revenue
– Leads
– Advertising performance
– Business growth
– Automation outcomes
10. THIRD-PARTY SERVICES
Therafic may rely on third-party services including:
– Stripe
– Twilio
– GoHighLevel
– Meta
– OpenAI
– Hosting providers
Therafic is not liable for outages, policy changes, data loss, or failures caused by third-party providers.
11. INTELLECTUAL PROPERTY
All Therafic systems, software, branding, content, workflows, designs, and materials remain Therafic property.
12. LIMITATION OF LIABILITY
Therafic shall not be liable for:
– Lost revenue
– Lost profits
– Regulatory penalties
– HIPAA violations
– Data loss
– Marketing performance
– SMS delivery issues
– AI inaccuracies
– Third-party failures
Maximum liability shall not exceed the amount paid during the previous thirty (30) days.
13. INDEMNIFICATION
Users agree to indemnify and hold harmless Therafic from claims arising from:
– User conduct
– User communications
– Regulatory violations
– SMS violations
– HIPAA violations
– Use of uploaded content
– Breach of these Terms
14. NO GUARANTEES
Therafic does not guarantee:
– Leads
– Sales
– Revenue increases
– Advertising performance
– Search rankings
– Appointment bookings
– Business results
15. TERMINATION
Therafic may suspend or terminate services immediately for:
– Non-payment
– Abuse
– Fraud
– Spam
– Regulatory violations
– Threats to platform security
16. GOVERNING LAW
These Terms are governed by the laws of the State of New York.
17. CHANGES TO TERMS
Therafic may modify these Terms at any time.
